What is the income requirement for an I-864 Affidavit of Support?
The sponsor must show income of at least 125 percent of the Federal Poverty Guidelines for their household size. Active-duty US military sponsoring a spouse or child need only 100 percent. The 2024 guidelines apply to petitions filed in 2024-2025.
What if my income is too low?
You can use significant assets (generally worth five times the shortfall, or three times for a spouse or child of a US citizen), count a household member's income on Form I-864A, or add a qualifying joint sponsor who independently meets 125 percent.
Who counts in household size for the I-864?
Household size includes the sponsor, spouse, dependent children, other dependents claimed on taxes, the intending immigrants, and anyone the sponsor is still obligated to support under a prior Affidavit of Support.
Is the Affidavit of Support legally enforceable?
Yes. Form I-864 is a legally binding contract. The obligation continues until the immigrant becomes a US citizen, is credited with 40 qualifying quarters of work, leaves the US permanently, or dies.
