What are FLSA liquidated damages?
Under the Fair Labor Standards Act, if your employer willfully underpaid you, you may be entitled to liquidated damages equal to the amount of unpaid wages — effectively doubling your recovery. The employer can avoid this only by proving it acted in good faith.
Should I file a wage claim with the Department of Labor or in court?
The DOL Wage and Hour Division investigates FLSA violations at no cost to you. However, filing in court (or small claims for smaller amounts) gives you more control and the ability to claim liquidated damages and attorney fees if you use a lawyer.
What is the overtime threshold under US federal law?
