Frequently Asked Questions

How much does it cost to register a trademark with the USPTO?
As of 2024, USPTO charges $250 per class for a TEAS Plus application or $350 per class for TEAS Standard. There is no separate registration fee. With an attorney, expect $1,000 to $2,500 per class including government fees for a straightforward application.
What is the difference between TEAS Plus and TEAS Standard?
TEAS Plus costs $250 per class but requires you to select your goods/services descriptions from the USPTO's pre-approved ID Manual and meet stricter completeness rules. TEAS Standard costs $350 per class and lets you write custom descriptions. Failing TEAS Plus requirements triggers an extra $100 per-class fee.
Do I need a US attorney to file a trademark?
If you are domiciled outside the United States, the USPTO requires you to be represented by a US-licensed attorney. US-domiciled applicants may file on their own, but an attorney improves the odds of avoiding office actions and refusals over descriptiveness or likelihood of confusion.
How long does a US trademark last?
A federal trademark registration lasts 10 years and can be renewed indefinitely. However, you must file a Section 8 Declaration of Use between the 5th and 6th year, and a combined Section 8 and 9 renewal every 10 years, or the registration is cancelled.
