An uncontested MSA where both parties agree on everything typically costs $2,000–$8,000 combined. A mediated agreement (parties negotiate with a mediator then each hire a lawyer to review) typically costs $3,000–$10,000. A fully contested agreement negotiated by adversarial lawyers costs $10,000–$50,000+. The number of contested issues is the main cost driver.
What is a marital settlement agreement?
A marital settlement agreement (MSA), also called a separation agreement or property settlement agreement, is a legally binding contract that resolves all issues in a divorce: property division, debt allocation, spousal support/alimony, child custody and parenting plan, and child support. Once incorporated into the divorce decree, it has the force of a court order.
Can I write my own separation agreement?
Technically yes, but it's risky. A DIY agreement that doesn't comply with state formalities, fails to address key issues, or is ambiguous will cause expensive problems later. At minimum, have a family law attorney review any agreement before you sign. The cost of a review ($500–$1,500) is far less than the cost of litigating a flawed agreement later.
