There is no universal formula. Two common methods are: (1) the multiplier method — multiply your total medical bills by 1.5–5× based on injury severity; (2) the per diem method — assign a daily dollar value to your suffering and multiply by the number of days affected. Insurance adjusters and attorneys use both methods as starting points for negotiation.

Many states cap non-economic damages (pain and suffering, emotional distress) in specific contexts — most commonly medical malpractice. General personal injury caps are less common. States like California, Florida, and New York have no general cap. Texas, Ohio, Colorado, and others cap in specific circumstances.

Typical multipliers: 1.5× for minor soft tissue injuries with full recovery; 2–3× for moderate injuries requiring surgery or months of treatment; 4–5× for severe injuries with permanent impairment or chronic pain. Insurance companies often start at 1.5–2×; experienced attorneys negotiate higher based on documented severity.
