How much can I settle my debt for in the US?
Creditors often accept 40 to 60 cents on the dollar on charged-off unsecured debt, though results vary. Accounts must usually be significantly delinquent before a creditor will consider a lump-sum settlement, which itself damages your credit.
Is forgiven debt taxable?
Generally yes. If a creditor cancels $600 or more, it issues a Form 1099-C and the forgiven amount may be taxable as ordinary income. However, under IRC Section 108 you may exclude forgiven debt to the extent you were insolvent (liabilities exceeded assets) immediately before the cancellation.
How do debt settlement fees work?
Under the FTC Telemarketing Sales Rule, a for-profit settlement company cannot charge a fee until it actually settles a debt. Fees commonly run 15 to 25 percent of the enrolled or forgiven debt. High fees can erase much of your savings.
Is debt settlement better than bankruptcy?
It depends. Settlement avoids a bankruptcy filing but requires cash, hurts your credit, and can create taxable income. Chapter 7 can eliminate qualifying unsecured debt entirely, and Chapter 13 reorganizes it. Compare all options with a bankruptcy attorney before enrolling in a settlement program.
