How is bail set in the US?
Many jurisdictions use a bail schedule that assigns a preset amount to each offence. A judge can then raise, lower, or waive it at arraignment based on flight risk, danger to the community, ties to the community, and prior record. Some states have replaced cash bail with pretrial risk assessments.
What is a bail bond premium?
If you use a bail bondsman, you pay a non-refundable premium (typically 10% of the bail amount, sometimes lower) and the bondsman posts a surety bond for the full amount. Unlike a cash deposit paid directly to the court, the premium is never returned even if you appear at all hearings.
What does released on recognizance mean?
Released on recognizance (ROR) means you are released without posting money, on your written promise to appear. It is common for low-level offences, first-time defendants, and those with strong community ties. Conditions such as check-ins or no-contact orders may still apply.
Can bail be denied entirely?
Yes. Courts can deny bail (preventive detention) for very serious offences, when the defendant poses a demonstrated danger, or where there is a serious flight risk. The federal system and many states allow detention hearings for qualifying offences.
